What Steps Do I Take to File for Bankruptcy?

To get the bankruptcy process off to the right start, it’s important to meet with a local attorney who can educate you on the law, explain your rights as a debtor, and ultimately make sure each step is completed correctly. What I do at my office is break the process of getting a case prepared and filed into 3 steps:

  1. Meet, Greet, and Establish a Payment Plan. The first step is for us to sit down for a free consultation and try to get to know one another. During this talk, you tell me about your specific situation and goals while I teach you about the law as it applies to your case. Once we’ve had that discussion and you feel comfortable working with me, we decide on a payment amount for your attorney’s fee. We then break that payment up into 3 manageable chunks.
  2. Complete Necessary Paperwork. For the second step, I give you some paperwork to take home, fill out, and bring back to my office. Together, we review the paperwork to make sure I have all the information I need in order to then type it up and put it in the format the court wants to see.
  3. Sign & File the Paperwork. Finally, the third step is where you come back to my office once the paperwork is properly drafted. We review the finalized version together, and that’s when we go ahead and sign and file the case.
